Yeah, so the latest Nintendo console receiving an update isn't the 3DS, but instead it's predecessor. Many say that this is to make the DSi transfer-ready for the 3DS update. Which is coming... soon... we hope.

If you get it you wont be able to use Flashcart's anymore n your system will be bricked rendering it useless

I'm pretty sure there are laws in place that make that sort of thing illegal for big businesses to do that to customers.

I don't think they'll brick the system but using unauthorized software can brick a system, like joke/fake software, or software that modifies the system in anyway. I think that's what Nintendo means, I don't think they'll literally destroy your system. The most they'll do is probably ban you from Nintendo Wi-Fi.
