[Unanswered] My 3ds got stolen.It's not out of state. What should I do?

Angry My 3ds got stolen.It's not out of state. What should I do?

Well, I've got a bit of a complex issue going on here, so bear with me.

About a year ago, I purchased a 3ds. It took a lot of work (I'm 14), and I loved the console. However, my father, who doesn't have custody over me, stole my 3ds (due to him not having custody, this can be considered theft). He claims he sold it at a Gamestop, and I want to track this down. This isn't me lying, either. My father has a mental disorder and has done this before.

So far, I have contacted local Gamestops and Nintendo to potentially prevent the selling and formatting of the 3ds. I intend to file a police report and contact Gamestop and Nintendo AGAIN to see if a store may have it or if it has been used.

Assuming I own enough to prove my ownership of the console to ANYONE, what should I do?

That sucks, and I am so sorry, but there's really nothing to do except buy a new one, maybe check craigslist?

Do you have the original retail box that your 3DS came in? If you do, on the side of the box should be your serial number. (example, CWXXXXXXX)

Technically since you're not 18, you can't legally claim ownership over anything. However, since your father does not have custody over you, he technically committed theft against whoever does have custody over you.

This is right. Obviously it's not worth suing your father because you'd pay 100 times more in legal fees, but you if it can be proved he committed theft, he'd most likely be fined in same way or another (although I cannot guarantee you'd get any of the money). I recommend you do a little research to see what the law would do in this situation.

I can't figure out the reply system. :/ but yes I do have the serial number. I filed a Police Report on it, so hopefully that should help. I know pre-owned 3ds's don't sell THAT fast at Gamestop, so it's probably still there. I don't intend to sue him, I just want the damned console back lol

edit: I contacted Nintendo and Gamestop, they said they would "divulge" the location of the system if they know it and are contacted by the police/with a report. That's why I filed one.

I researched it. I can sue him... And he will be put in jail... XD that's it for that, but he's probably not going to jail. It's only when the property is valuable (more valuable than this).

Also, when the property is taken by the police they will return it IF I can prove it's mine. So basically researching it didn't do much. But I CAN prove it's mine!!!

This is more of a legal matter than a gaming matter. It sounds like you've been on the right track anyway. Normally when stuff like this is stolen, police check local pawn shops, if it's not already in one then they leave a description (serial number, etc.) in case it turns up. I think that GameStop, since they buy and sell used stuff, falls under the same procedure. Since you have reported it stolen, if you can establish positive identification (serial number, the Mii in your streetpass plaza, etc.) then whichever store has it should be legally obligated to return it.

Mostly your local police department should be advising you here, not us.

this happened to me with my mum (my nan has custerdy on me) who was on drugs and she needed money so she stole my wii which had about 50 pounds worth of games on so my nan buyed a new wii and nintendo got me the games back

O_o Holy crap. I got it back. I eventually tracked it down to a house, and it was owned by a 7 year old. The parents were kind enough to give it back. And I've been playing Pokemon ever since. XD my luck
