does anyone has this problem? these buttons wont work even taking battery out powering off and on. need help.

Definitely sounds like a hardware issue. If you just bought it, I would take it back and exchange it. If it's a year or two old, send it to Nintendo and have it fixed.

Is it the Circle Pad Pro for the regular 3DS, or the Circle Pad Pro for the XL?
